Inconforme con esta decisi\u00f3n, el c\u00f3nyuge sobreviviente impugn\u00f3, buscando anular la sentencia que disolv\u00eda el v\u00ednculo matrimonial.<\/p>\n\n\n\n<p>La Primera Sala de la SCJN determin\u00f3 que poner fin al juicio de divorcio por la muerte de uno de los c\u00f3nyuges no solo ser\u00eda inconstitucional, sino que adem\u00e1s ignorar\u00eda la voluntad expresada en vida por la persona fallecida. Seg\u00fan el fallo, mantener el v\u00ednculo matrimonial tras el deceso podr\u00eda permitir al c\u00f3nyuge sobreviviente reclamar derechos hereditarios, lo que ir\u00eda en contra de la voluntad expl\u00edcita de la fallecida de disolver el matrimonio.<\/p>\n\n\n\n<p>La Corte subray\u00f3 que el respeto a las decisiones tomadas en vida es fundamental para garantizar el libre desarrollo de la personalidad y la dignidad humana.
